Hereinafter referred to as the Seller or the Online Store.
These Terms of Use govern the use of the Online Store, ordering, payment, delivery, the right of withdrawal, return of goods, and the handling of complaints.
By placing an order in the Online Store, the Buyer confirms that they have read and agree to these Terms.
1.1. The Online Store offers ready-made and handmade goods, as well as goods that may, at the Buyer's choice, be made to individual order or personalised.
1.2. If the Buyer is a consumer and purchases goods through the Online Store, a distance contract is concluded between the Buyer and the Seller.
1.3. The distance contract is governed by the laws and regulations in force in the Republic of Latvia, including the Consumer Rights Protection Law, Cabinet Regulation No. 255 “Regulations Regarding Distance Contracts”, as well as other applicable laws and regulations of the Republic of Latvia and the European Union.
1.4. For the purposes of these Terms, the Buyer means a natural or legal person who makes a purchase in the Online Store. The specific consumer rights provided for by consumer protection legislation apply to natural persons who purchase goods for purposes unrelated to their economic or professional activity.
2.1. The main characteristics, price, availability, possible personalisation options, and other essential information about the goods are specified in the description of the respective product.
2.2. Prices in the Online Store are stated in euros (EUR). Before confirming the order, the Buyer is shown the total price of the goods and the applicable delivery costs.
2.3. As some goods are handmade, individual items may have slight visual differences from the images shown in the Online Store. Minor differences in colour tone, pattern, placement of decorative elements, or other details characteristic of handmade products shall not in themselves be considered a defect if they do not affect the essential characteristics, quality, or functionality of the goods.
2.4. Colours displayed on screen may differ slightly from the actual colours depending on the display settings of the Buyer's device.
3.1. To place an order, the Buyer selects the desired product, provides personalisation information where necessary, adds the product to the shopping cart, completes the required fields, and selects an available delivery and payment method.
3.2. Before confirming the order, the Buyer has the opportunity to review the contents of the order, the total price, and the delivery costs.
3.3. The Buyer is responsible for the accuracy of the information provided in the order, including the recipient's name, delivery address, telephone number, email address, and personalisation information.
3.4. The order is considered received once it has been successfully placed in the Online Store.
3.5. A paid order becomes binding on the Seller once payment has been successfully received/confirmed.
3.6. If, for objective reasons, the ordered goods cannot be delivered or produced, the Seller shall inform the Buyer as soon as possible and offer an alternative solution or refund the amount paid for the unfulfilled order.
4.1. A custom-made or personalised product is a product made according to the Buyer's instructions or to which, at the Buyer's request, an individual design, name, text, date, image, colour combination, size, or other personalisation is added, resulting in a product made specifically for that Buyer.
4.2. The Buyer is responsible for the accuracy of the information submitted for personalisation. Before confirming the order, the Buyer should carefully check the spelling of names, dates, text, and any other personalisation information.
4.3. If the Seller sends the Buyer a design or personalisation proof for approval before production, production may begin after the Buyer's approval has been received.
4.4. Once production of a personalised product has begun, changes to the order are possible only if the Seller is technically able to make them. Additional changes may result in additional costs, of which the Buyer will be informed before such changes are made.
5.1. The currency used for payments in the Online Store is the euro (EUR).
5.2. Electronic payments in the Online Store are provided through the MakeCommerce payment platform, operated by the licensed payment institution Maksekeskus AS.
5.3. Depending on the payment methods available in the Online Store at the relevant time, the Buyer may pay by payment card and/or use the available online banking payment methods.
5.4. The currently available payment methods are displayed during checkout.
5.5. The data required to process the payment is transferred to the relevant payment service provider to the extent necessary for processing the payment.
5.6. When using an online banking payment method, after completing the payment the Buyer is advised to return to the Online Store using the “Return to merchant” button provided by the payment system so that the order status can be updated correctly.
6.1. Unless otherwise stated in the product description, ready-made goods that are in stock are usually prepared for dispatch within 1–3 business days after payment has been received.
6.2. The production time for custom-made or personalised goods is usually 5–15 business days, unless a different period is stated in the product description or agreed individually with the Buyer.
6.3. If production of a personalised order requires the Buyer's approval, additional information, or approval of a design proof, the production period is calculated from the time when the Seller has received all information required for production and the Buyer's approval.
6.4. The stated production or order preparation time is not the same as the carrier's delivery time. The estimated delivery time depends on the destination and the selected delivery service.
6.5. Goods are delivered using the delivery services indicated in the Online Store: Omniva, DPD, Latvijas Pasts, Venipak.
6.6. The applicable delivery costs are displayed to the Buyer before the order is confirmed.
6.7. Unless a specific delivery period has been agreed otherwise, the Seller shall ensure delivery of the goods within the period prescribed by applicable laws and regulations.
6.8. If a significant delay in the production or dispatch of an order is expected, the Seller shall inform the Buyer and, where necessary, agree on a new fulfilment period.
6.9. The Buyer is responsible for providing correct delivery information. If the shipment cannot be delivered due to an incorrect address or contact information provided by the Buyer, or because the shipment was not collected on time, the Buyer may be charged the cost of reshipping.
6.10. If goods are delivered outside the European Union, the recipient may be subject to customs duties, import taxes, or other import-related charges imposed by the destination country. Unless otherwise provided by applicable law, such charges imposed by the destination country shall be borne by the Buyer.
7.1. A consumer has the right to withdraw from a distance contract within 14 days without giving a reason, except in cases provided for by applicable laws and regulations.
7.2. For goods, the withdrawal period generally begins on the day when the Buyer or a third party designated by the Buyer, other than the carrier, has acquired physical possession of the goods.
7.3. To exercise the right of withdrawal, the Buyer must clearly inform the Seller of their decision to withdraw from the contract before the withdrawal period expires by sending a notice to creora.art@gmail.com.
7.4. After exercising the right of withdrawal, the Buyer must return or hand over the goods to the Seller without undue delay and no later than 14 days after sending the notice of withdrawal.
7.5. The direct costs of returning the goods shall be borne by the Buyer, except where the goods were delivered incorrectly, are damaged, or do not correspond to the order and the Seller is responsible for the non-conformity.
7.6. The Buyer is liable only for any diminished value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics, and functioning.
7.7. The Buyer is not required to retain the packaging solely in order to exercise the right of withdrawal. However, when returning the goods, the Buyer must package them in such a way that they are not damaged during transportation.
7.8. When the right of withdrawal is exercised, the Seller shall refund all payments received from the Buyer, including the initial standard delivery costs, except for additional costs resulting from the Buyer's choice of a delivery method that is more expensive than the least expensive standard delivery method offered by the Seller.
7.9. The refund shall be made without undue delay and no later than 14 days from the day on which the Seller receives the Buyer's notice of withdrawal. The Seller may withhold the refund until the goods have been received back or until the Buyer provides evidence that the goods have been sent back, whichever occurs first.
7.10. The refund shall be made using the same means of payment used by the Buyer for the original transaction, unless the Buyer and the Seller have expressly agreed otherwise.
8.1. In accordance with applicable laws and regulations, the 14-day right of withdrawal does not apply to goods made according to the Buyer's specifications or clearly personalised.
8.2. This may include, for example, goods featuring an individually selected name, text, date, image, or a design created specifically for the Buyer, as well as other goods made according to the Buyer's individual specifications.
8.3. The fact that a product is handmade does not in itself remove the Buyer's right of withdrawal. This exception applies only to goods that are actually made according to the Buyer's instructions or are clearly personalised.
8.4. The exception to the right of withdrawal does not limit the Buyer's right to make a claim if a personalised or custom-made product is damaged, does not correspond to the order, or otherwise fails to conform to the contract.
9.1. The Seller is responsible for ensuring that the goods delivered to the Buyer conform to the contract in accordance with the laws and regulations of the Republic of Latvia.
9.2. The consumer is entitled to submit a claim to the Seller regarding non-conformity of the goods with the contract within two years from the date of delivery of the goods.
9.3. The consumer must submit a claim to the Seller regarding the identified non-conformity no later than two months from the date on which the non-conformity was discovered.
9.4. A complaint or claim may be submitted by emailing creora.art@gmail.com. It is recommended to include the order number, a description of the issue and, where possible, photographs that help assess the condition of the goods.
9.5. If the goods do not conform to the contract, the consumer is first entitled, in accordance with applicable laws and regulations, to request that the Seller remedy the non-conformity free of charge or replace the goods with conforming goods, except where the chosen remedy is impossible or disproportionate.
9.6. In cases provided for by applicable laws and regulations, the consumer may be entitled to request a price reduction or termination of the contract and a refund of the amount paid.
9.7. The Seller shall not be liable for damage arising after the goods have been delivered to the Buyer as a result of improper use, failure to follow care instructions, mechanical damage, or other circumstances for which the Seller is not responsible.
10.1. For questions, claims, or complaints, the Buyer may contact the Seller by emailing creora.art@gmail.com.
10.2. The Seller shall review the Buyer's submission and provide a response in accordance with the procedure and within the time limit prescribed by applicable laws and regulations. The Seller shall provide a written response to a consumer's written complaint regarding a dispute no later than 15 business days from the date of receipt of the complaint.
11.1. The Seller processes the Buyer's personal data only to the extent necessary to process orders, perform the distance contract, administer payments, deliver goods, provide customer service, maintain accounting records, and fulfil obligations imposed by applicable laws and regulations.
11.2. Personal data necessary for fulfilment of the order may be transferred to payment service providers, delivery and logistics service providers, and other service providers only to the extent necessary to provide the relevant service or comply with legal requirements.
11.3. Marketing communications are sent only where there is an appropriate legal basis. Where marketing communications are sent on the basis of the Buyer's consent, the Buyer may withdraw that consent at any time.
11.4. More detailed information about the processing of personal data, data retention periods, recipients of data, and the rights of data subjects is available in the Online Store's Privacy Policy.
12.1. Original designs, illustrations, photographs, graphic elements, texts, and other content created by the Seller and published in the Online Store are protected in accordance with applicable intellectual property laws.
12.2. Copying, reproducing, or using the content of the Online Store for commercial purposes without the Seller's permission is prohibited, except in cases permitted by applicable law.
12.3. By submitting an image, text, logo, or other material for the production of a personalised order, the Buyer confirms that they have the right to use that material for the relevant purpose.
13.1. The Seller shall not be liable for failure to perform obligations or delays in performance caused by circumstances that the Seller could not reasonably foresee or prevent, including significant transport disruptions, natural disasters, restrictions imposed by public authorities, or other force majeure circumstances.
13.2. In such circumstances, the Seller shall, where possible, inform the Buyer of the delay and its possible impact on fulfilment of the order.
14.1. If, due to a technical or human error, an obviously incorrect price or other material information is displayed in the Online Store, the Seller shall contact the Buyer after discovering the error and inform the Buyer of the situation.
14.2. In such a case, the Buyer shall be offered the opportunity to confirm the order at the correct price or cancel the order. If the Buyer chooses to cancel the order or no agreement is reached, the amount received for the relevant order shall be refunded.
15.1. The Seller and the Buyer shall first seek to resolve any disagreement through mutual negotiations and written communication.
15.2. If the Buyer believes that the Seller has infringed their consumer rights, the Buyer is first entitled to submit a written complaint to the Seller.
15.3. If the dispute cannot be resolved by mutual agreement, the consumer may, in accordance with applicable laws and regulations, apply to the Consumer Rights Protection Centre of Latvia (PTAC), the Consumer Dispute Resolution Commission, another competent out-of-court dispute resolution body in the relevant field, or a court.
15.4. In the case of cross-border consumer disputes, the Buyer may use consumer advice and out-of-court dispute resolution mechanisms available within the European Union.
15.5. The European Union's former Online Dispute Resolution (ODR) platform is no longer in use, as its operation has been discontinued.
16.1. In matters not covered by these Terms, the Seller and the Buyer shall comply with the laws and regulations in force in the Republic of Latvia and, where applicable, the European Union.
16.2. Nothing in these Terms limits any rights granted to consumers by applicable laws and regulations.
16.3. The Seller may update these Terms where necessary due to changes in the operation of the Online Store or legal requirements. An order shall be governed by the version of the Terms that was in force at the time the order was placed.
